Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity.)

Instructions on the Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day:

on which you or a third party designated by you, other than the carrier, has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered together;
on which you or a third party designated by you, other than the carrier, has taken possession of the last item, provided that you have ordered several goods as part of a single order and these are delivered separately;
on which you or a third party designated by you, other than the carrier, has taken possession of the last partial shipment or the last item, provided that you have ordered goods that are delivered in several partial shipments or pieces;
on which you or a third party designated by you, other than the carrier, has taken possession of the first item, provided that goods are delivered regularly over a specified period of time as part of an order.

To exercise your right of withdrawal, you must inform us (Kombuchery GmbH, Torstraße 105–107, 10119 Berlin, Germany, email address: imprint@kombuchery.de) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

You may also exercise your right of withdrawal online by using a correspondingly labelled button (“Withdraw from contract” or similar wording) on the respective country-specific Kombuchery website. If you use this online function, we will immediately provide you, on a durable medium (e.g. by email), with an acknowledgement of receipt containing information on the content of your withdrawal declaration and the date and time of its receipt.

You may also electronically complete and submit the model withdrawal form or any other unequivocal statement on the respective country-specific Kombuchery website. If you make use of this option, we will send you an acknowledgement of receipt of such withdrawal without delay (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and, in any event, no later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period has expired.

Please do not send returns to our office address. Returns must only be sent to the return address specified in the return form or order confirmation.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusions and Grounds for Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs;
for the supply of goods that are liable to deteriorate rapidly or whose expiry date would be rapidly exceeded;
for the supply of alcoholic beverages, the price of which was agreed upon at the time the contract was concluded, but which cannot be delivered earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no control;
for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts:

for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
for the supply of food packaging units (e.g. trays of 6) that are sold exclusively as a closed sales unit and are not intended for individual sale, if, after the outer packaging has been opened or removed, a return can no longer reasonably be accepted for reasons of hygiene, labelling requirements or product-specific considerations, in particular because the information required by law is provided exclusively on the outer packaging.

General Information

Please avoid damaging or soiling the goods. If possible, please return the goods in their original packaging together with all accessories and all packaging components. Where necessary, please use suitable protective outer packaging.

If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against damage in transit.

Please do not return goods carriage forward or with postage due.

Please note that the above points are not prerequisites for the effective exercise of your right of withdrawal.
